Many companies hesitate to use Artificial Intelligence (AI) out of fear of violating data privacy regulations.

70 percent of all companies, and even 80 percent of companies that use Artificial Intelligence (AI), see data privacy violations as the greatest risk when using AI, according to a Bitkom survey. Additionally, 62 percent believe that AI services in the cloud cannot comply with data privacy requirements.

How AI can be used in a company in compliance with data privacy regulations and which legal provisions need to be observed are addressed in a new practical guide "Artificial Intelligence and Data Privacy" by the digital association Bitkom, now available for free download.

“There is still a lot of uncertainty surrounding the use of AI. For Germany to not fall behind in Artificial Intelligence, we need more clarity and security in dealing with legal requirements,” says Susanne Dehmel, member of Bitkom's management board.

The practical guide "Artificial Intelligence & Data Privacy" serves as a comprehensive reference to support companies and organizations in the data privacy-compliant use and implementation of AI technologies.

The guide begins with a brief definition of when AI is discussed in contrast to traditional software and which laws may become relevant in the use of AI. In the extensive second part, essential provisions of the European General Data Protection Regulation (GDPR) and their significance in the use of AI are explained – from transparency and information obligations to data protection impact assessments. This chapter also discusses what content an internal company policy on AI use must contain. Then, a practical example from the automotive industry is used to illustrate how Artificial Intelligence can be implemented in a company in compliance with data privacy. The guide concludes with two detailed checklists for training your own AI models and using third-party AI systems. These checklists help company leaders proceed step by step to ensure data privacy compliance in AI usage.
